CYPRESS LANDING DINGHY
STORAGE FACILITY GUIDELINES
These guidelines are intended to reflect the intent and be consistent
with the Cypress Landing Covenants and the August 22, 2006 HOA Board
Resolution.
Purpose: The dinghy storage racks
are intended to serve as an HOA amenity and convenience for property
owners who have slips at the Marina. It is not intended as an off site
storage space for dinghies that are not used on a regular basis.
1- Definition/Responsibility
The dinghy storage area is located below the
walkway to the upper level of the Bay Club. Currently there are 12
storage spaces available. The storage area comes under the
responsibility of the Cypress Landing Master Home Owners Association
(CLMHOA). However the HOA has given operational management of the
dinghy storage facility to the Marina Association.
The dinghy storage area is intended for the sole
use of Marina Association slip holders who also currently have a boat
located in their slip.
2- Contact/Supervision
Currently all 12 spaces are assigned to slip
holders of the Cypress Landing Marina Association.
There is a waiting list that is maintained by the
dock master. Individuals that desire dinghy storage space should
contact the dock master and have their name placed on the list.
Effective January 1, 2007, only Cypress Landing property owners will be
eligible for future space if and when they become available. Current
slip holders who have an assigned dinghy space but are not property
owners at Cypress Landing will be grandfathered.
3- Space Allotment/Assignment
Spaces have been assigned on a first come
basis. The waiting list will be used to fill any spaces that are
relinquished.
If additional dinghy spaces are constructed, the
waiting list will be used to fill those spaces
4- Audit/Compliance
The use of the storage area will be monitored by
the dock master. Users of the storage area are requested to notify the
dock master when a space will be empty for an extended period of time or
is no longer required. Users are required to properly maintain their
dinghies. Owners of dinghies that are deemed to be not seaworthy will
be asked to remove their dinghy and vacate their assigned space. If it
becomes apparent that a dinghy has not been used for 12 consecutive
months, the dock master may approach the dinghy owner and ask them to
justify continued use of the rack space.
5- Security
Should a hurricane or storm be imminent, space
holders may be directed by the dock master to remove or secure their
stored dinghies. Space holders are permitted to secure their dinghies
with locking devices. Covers for dinghies are also permitted. Storage
of motors and gasoline is not permitted in the storage area.
6- Maintenance
The storage areas are intended to be a “no cost”
amenity. The Marina Board reserves the right to perform periodic
maintenance of the racks and storage area and may require that all
dinghies be removed for such maintenance.
7 – Association Indemnification:
With the completion of the Dinghy Rack Application, the space holder
acknowledges and agrees to indemnify and hold harmless the Cypress
Landing Master Homeowners Association (CLMHOA) and the Marina
Association (CLMA) from any and all claims, loss, damage, theft or storm
damage to any property arising out of the use of the storage area and
the space holder releases and indemnifies the Association from any and
all claims, losses, liabilities, demands, actions, or causes of action
of any kind or character, including, without limitation, attorneys fees,
costs and expenses, whether known or unknown, arising out of the space
holder’s use of the storage area. Space holders are responsible for
any damage that their dinghy may cause to other dinghies and/or private
and/or community property as a result of high winds and/or storms.
